Getaways terms and conditions

General
Thank you for visiting JetBlue Getaways® ("Getaways"). Getaways is a vacation package service offered by JetBlue Airways Corporation ("JetBlue"), acting as a broker or intermediary, and its business partner EzRez. Getaways is separate and distinct from and is not affiliated with Hotels.com or Hertz and the hotel or car products that can be booked separately on http://www.jetblue.com/hotels/index.html and http://www.jetblue.com/cars/index.html. Air transportation for Getaways is supplied by JetBlue. Other travel services for Getaways' vacation services and accommodations, including hotel and rental cars, are supplied directly to the consumer by independent companies, referred to herein as "Travel Suppliers." The Travel Suppliers are not agents, employees, or subcontractors of JetBlue and JetBlue is not responsible for their acts or omissions. Please note, these Terms and Conditions do not apply to bookings made via Ebay.

The following terms and conditions (hereinafter "Agreement") apply to all Getaways vacation packages. The words "You", "Your" or "Yours" used herein refer to the person booking the Getaways vacation package. By booking a Getaways vacation package, You agree to be bound by this Agreement and warrant and represent that You are at least 18 years old possessing the legal capacity to conduct business with JetBlue in accordance with this Agreement. JetBlue reserves the right to revise or change the terms of this Agreement at any time and without notice to You, so You should periodically visit this site to learn of any revisions or changes.

In addition to this Agreement, JetBlue's Contract of Carriage available at http://www.jetblue.com/contractofcarriage and Passenger Rules Tariffs on file with the Department of Transportation will apply to the air travel component of any Getaways vacation package.

ADDITIONAL TERMS AND CONDITIONS WILL APPLY TO SPECIFIC TRAVEL SUPPLIERS (HOTEL, CAR) WITH WHICH YOU ELECT TO DEAL. YOU SHOULD VISIT THE WEBSITES OF THE TRAVEL SUPPLIERS WITH WHICH YOU ELECT TO DEAL SO THAT YOU CAN REVIEW AND AGREE TO THE TERMS AND CONDITIONS THAT APPLY TO THEIR PRODUCTS AND SERVICES.

By booking a Getaways vacation package, You agree to be bound by the terms and conditions of these Travel Suppliers.

Payment/Purchase
Advertised package prices do not include taxes and fees applicable to air fare. However, all prices quoted on the booking page are in US Dollars ($) and are inclusive of (i) airfare (including government taxes and government fees, including without limitation, airport passenger facility charges, September 11th Security Fee, customs and immigration fees, and federal segment fees); (ii) hotel rates (including hotel taxes); and (iii) the fee for intermediary services provided by JetBlue to facilitate the booking of and payment for services and accommodations provided by the Travel Suppliers. Car rental taxes and fees are not included. All prices and rates are subject to availability. Full payment via credit card is required at the time of booking unless, in the case of flight/hotel or flight/hotel/car packages, a $50 non-refundable deposit to hold the booking through the end of the day (11:59 p.m. Eastern Time or 8:59 Pacific time) has been arranged. Packages may only be held if the reservation is made through 1-800-JETBLUE (538-2583) and will only be held through the end of the day (11:59 p.m. Eastern Time or 8:59 Pacific time); this option is not available over jetblue.com. Customers with hearing or speech impairments can call our toll-free TTY/TDD telephone number, 1-800-336-5530. Packages may not be held if package is only a flight/car package. If the booking is confirmed and full payment is made by the end of the day (11:59 p.m. Eastern Time or 8:59 Pacific time), the $50 deposit will be applied toward the total amount due. If the booking is not confirmed and full payment is not made by the end of the day (11:59 p.m. Eastern Time or 8:59 Pacific time), the $50 deposit will be forfeited. Any changes/cancellations to confirmed bookings made after the end of the day (11:59 p.m. Eastern Time or 8:59 Pacific time) will be assessed the full change and cancellation penalties stated below. JetBlue requires three days advance notice prior to departure date to process a reservation. Requests made within three days will be handled on a per request basis and are subject to Travel Supplier availability and confirmation. Adjustments made to package pricing will not be made after payment has been applied. After payment has been made, no subsequent rate reductions will be applied retroactively. JetBlue reserves the right to re-invoice Your package should an error be made in computing Your package price. Children 13 years and Younger may not travel alone and must be accompanied by an adult 18 years or older on the same package.

Change Policy Applicable to Getaways Flight/Hotel or Flight/Hotel/Car Vacation Packages
JetBlue does not guarantee that changes can be made on all or parts of packages. IN ADDITION TO THE TERMS HEREIN, EACH PROPERTY HAS SPECIFIC CHANGE POLICIES. PLEASE SEE THE TAB MARKED "CHANGES/CANCELLATIONS" UNDER EACH HOTEL PROPERTY FOR THE CHANGE TERMS APPLICABLE TO THE HOTEL YOU HAVE BOOKED. Those terms are expressly incorporated herein. For all properties, changes, where permissible, are subject to a fee of $100 per person plus any increase in the package price. For all properties, name changes are not permitted. A change in the number of occupants per room may change the price of the package. If any changes involve an increase in price/rate, payment will be required at the time of change and the changes will not be effective until payment is received and availability is confirmed by the Travel Suppliers. Change terms may vary and additional fees may apply to changes during holiday travel periods. You will be advised of those additional terms at the time of booking. Changes may be made only by calling 1-800-JETBLUE (538-2583). No changes will be accepted by email or online. If a change is not made in accordance with JetBlue's change policy and the policy of the property, all money associated with the package will be forfeited. Other restrictions may apply at the time changes are made and You will be advised at that time of any restrictions.

There is no penalty or charge if You cancel only the car-component of your package, if you cancel before the scheduled departure of the first flight on your itinerary.

Cancellation Policy Applicable to Getaways Flight/Hotel or Flight/Hotel/Car Vacation Packages

PLEASE SEE THE TAB MARKED "CHANGES/CANCELLATIONS" UNDER EACH HOTEL PROPERTY FOR THE CANCELLATION TERMS APPLICABLE TO THE HOTEL YOU HAVE BOOKED. Those terms are expressly incorporated herein. For all properties, cancellations are subject to a fee of $100 per person. Any remaining amount may be applied to a future Getaways vacation package and is valid for one year from the date of cancellation. Getaways vacation credits may not be used for air-only travel on JetBlue Airways. No refunds will be given for cancellations. Terms of cancellation may vary and additional fees may apply to cancellations during holiday travel periods. You will be advised of those additional terms at the time of booking. Cancellations may be made only by calling 1-800-JETBLUE (538-2583). No changes will be accepted by email or online. If a cancellation is not made in accordance with JetBlue's cancellation policy and the policy of the property, all money associated with the package will be forfeited. Other restrictions may apply at the time cancellations are made and You will be advised at that time of any restrictions.

Change/Cancellation Policy Applicable to Getaways Flight/Car Package (no Hotel)
If you make only a flight reservation and a rental car reservation (not a flight, hotel, and car reservation), you may cancel or change your car reservation at any time before the scheduled departure of the first flight on your itinerary at no penalty with respect to the car-portion of your package. All flights are nonrefundable and nontransferable. Changes to the flight portion can be made prior to scheduled departure time for a fee of $100 per person plus any applicable difference in the package price. Cancellations can be made prior to scheduled departure time for a fee of $100 per person. If a change or cancellation results in overpayment, any remaining may be applied to a future Getaways vacation package and is valid for one year from date of cancellation. Getaways vacation credits may not be used for air-only travel on JetBlue Airways. Cancellations are for a Getaways credit only. No refunds will be given for cancellations. Changes and Cancellations may be made only by calling 1-800-JETBLUE (538-2583). No changes will be accepted by email or online. If a reservation is not changed or canceled prior to scheduled departure, all money associated with the package/reservation is forfeited.

Refunds for Unused Services
Unused package components may not be exchanged, transferred or refunded.

Air Travel
All air travel components of Getaways packages will be provided by JetBlue and are governed by (a) JetBlue's Contract of Carriage, a copy of which is available for inspection at all JetBlue ticket counters and at: http://www.jetblue.com/contractofcarriage.; (b) any restrictions on JetBlue fares to the extent such restrictions do not conflict with this Agreement; and, to the extent applicable, (c) JetBlue's International Passenger Rules Tariffs on file with the Department of Transportation. Please review these documents for, among other things, travel requirements and restrictions, liability and baggage limitations, requirements for the travel of minor children. For all domestic and international travel, JetBlue will require passengers to present government-issued photo identification. For international travel, please contact the relevant embassy or consulate for details on travel documentation requirements. It is Your responsibility to verify Your flight information and follow JetBlue's recommended check-in times, which can be found at: http://www.jetblue.com/help/topics/airports.asp. Failure to do so may result in the loss of Your seat to another passenger and/or denied boarding.

Car Rental Option
Car rentals include unlimited mileage, except rentals of specialty or luxury cars. Car rental rates do not include taxes, airport fees, insurance, options, underage driver charges (if applicable) or fuel costs, all of which must be paid directly to the rental company upon returning the vehicle. Taxes and fees may vary by state or location. A valid driver's license and major credit card will be required upon rental. If any car rental is returned late, additional charges may apply and will be payable by consumer directly to the rental company. A minimum age for booking may be required by the car rental company at the time of the request for booking or upon rental. Additional car rental restrictions may apply including age restrictions, so please consult the terms and conditions of the car rental company with which You elect to deal.

Hotel
Airport/hotel connections and transfers, parking fees, meals, shows, tours, tips, energy surcharges, telephone surcharges, telephone calls, liquor, room service, laundry, incidentals, or other items of a personal nature not otherwise specified in the quoted rate are not included as part of the Getaways package and are Your responsibility. JetBlue is not responsible for transportation between the hotel and the airport or any attractions.

JetBlue is not responsible for requests for special hotel accommodations. Although at the time of reservation/booking, You may request special accommodation, including, but not limited to, roll-a-ways, cribs, and non-smoking rooms, JetBlue does not guarantee the availability of these special requests. Disabled guest facilities may be limited, are subject to availability and cannot be guaranteed by JetBlue. It is Your responsibility to inform the front desk of these requests at time of check-in. Any additional fees required by the hotel for special requests must be paid directly to the hotel upon check-in and are not included as part of Your Getaways vacation package.

A major credit card, cash deposit and photo identification may be required upon check-in at the hotel. Additional hotel check-in restrictions may apply including age restrictions, and are subject to the terms and conditions of the hotel with which You elect to deal.

Substitutions
You authorize JetBlue to seek arrangements for substitute comparable hotel accommodations and car rental choices, if necessary, due to circumstances beyond the control of JetBlue.

Emergency Trip Insurance
Emergency Trip Interruption and Cancellation Insurance ("Insurance") is available through a third-party insurance broker at any additional cost. The Insurance is brokered by World Access America Travel Insurance and the Insurance benefits are underwritten by BCS Insurance Company or Jefferson Insurance Company. If You have purchased Insurance, please click here to access the Certificate of Insurance that describes Your Insurance benefits.

Other Promotions/Discounts
Except for promotions offered by JetBlue that expressly apply to a particular Getaways vacation package, no other promotional discounts, vouchers, coupons, or other discounts or special offers apply to Getaways vacation packages or any components thereof. If You are a registered TrueBlue member, You may earn TrueBlue points on only the airfare component of the Getaways vacation package. However, TrueBlue Points and TrueBlue Awards cannot be redeemed or used in connection with booking a Getaways vacation package.

Responsibility and Limitation of Liability
Services, accommodations, and products provided in connection with the Getaways vacation package service are subject to conditions imposed by the Travel Suppliers, including, but not limited to, Conditions of Carriage, tariffs, and government regulations. Except as specifically provided in JetBlue's Contract of Carriage, JetBlue shall not be held liable for any direct, indirect, special, or other consequential damages, whether stated in contract, tort, strict liability or otherwise, arising out of (a) the acts or omissions of any Travel Supplier or person or company rendering services in connection with Getaways vacation package service; (b) any use of this site; (c) any failure or delay or performance by any Travel Supplier; (d) any failure or delay arising out of use of this website, including, error, omission, interruption, defect, delay in transmission, or computer virus; (e) any failure or delay arising out of use of Travel Suppliers' websites. JetBlue is a vacation package service provider acting as an intermediary/broker and is only responsible for providing services of facilitating the booking of and payment for the vacation package accommodations and services You have selected. JetBlue is not responsible for errors or omissions in any printed or online material.

JetBlue is acting solely as an intermediary between Travel Suppliers and consumers to facilitate the negotiation, booking of, and payment for vacation package accommodations and services to be provided by Travel Suppliers directly to consumers. JetBlue shall not be the agent of the Travel Suppliers or any consumer for any purpose. JetBlue disclaims each and every fiduciary and other duty that could potentially arise under contract, a course of dealing, or otherwise and be owed to the Travel Suppliers or any consumer. JetBlue does not acquire any ownership, right of use, resale or other rights with respect to vacation package accommodations and services. JetBlue shall negotiate, book, and pay for vacation package accommodations and services only in the name of third-party consumers. JetBlue shall make payment for vacation package accommodations and services solely on behalf of third-party consumers and shall make payment for vacation package accommodations and services using the funds of consumers. The Getaways vacation package price quoted on the booking page includes applicable air and hotel fees and taxes, but does not include rental car taxes (as noted above) and the Travel Suppliers shall collect and remit all applicable sales, use, excise and other transaction-based taxes due with respect to the sale or provision of the vacation package accommodations and services to consumers and the payment of such taxes shall be the obligation of the consumer as part of the Getaways vacation package price.

Disclaimer of Warranty
JetBlue makes no warranty of any kind regarding this site or any of the products and services provided. All products and services provided by JetBlue are provided "as is" and JetBlue disclaims any representation or warranty.

Force Majeure
JetBlue shall not be liable for damages for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control or the control of any Travel Supplier with which you have elected to deal including, but not limited to, weather conditions, acts of God, force majeure, strikes, civil commotions, embargoes, and wars or other hostilities, whether actual, threatened or reported, and/or any other cause beyond the reasonable control of JetBlue or any of the Travel Suppliers with which You have elected to deal.

Governing Law
All disputes and any matters whatsoever arising out of or in connection with Getaways vacation packages or services provided under this Agreement shall be construed and enforced in accordance with the laws of the State of New York, without reference to its choice of law rules. All disputes and any matters whatsoever arising out of or in connection with Getaways vacation packages or services provided under this Agreement shall be brought in the federal and state courts located within the State of New York, New York County, as the venue of any action related to this Agreement, to the exclusion of the courts of any other state or country. Each consumer waives his/her right to a jury trial.
